BUSINESS CONTINUITY PLAN

Benjamin Securities, Inc is a member of FINRA and SIPC and is required to offer the following notifications:

Benjamin Securities, Inc has developed a Business Continuity Plan (BCP) detailing how we would respond to events that significantly disrupt our business. Since the timing and impact of disasters is unpredictable, we would remain flexible in responding to actual situations as they emerge. With this in mind, we are providing some information about our BCP.

If after a significant business disruption (SBD) you are unable to contact us by telephone or email, you should call the cell phone number of your key contact, the phone of William Baker at 631-681-3898 or go to our website at www.benjaminsecurities.com where we may post critical information.

Our firm’s policy in response to an internal or external SBD is to safeguard employees’ lives and firm property including the books and records, make a financial and operational assessment, and to quickly recover and resume operations in order to allow our customers to transact business. In the event we determine we are unable to continue to transact business, we will notify our customers and as necessary, will provide them with the direct contact information for either the investment banking intermediary or issuer entity.

Our BCP addresses alternative physical location of employees; data backup and recovery; financial and operational assessments; mission critical systems; alternate communications between the firm and customers, employees, and regulators; critical business constituents, banks, and counter-parties; and regulatory reporting.

Our plan anticipates two kinds of SBDs, internal and external. Internal SBDs affect only our firm’s ability to communicate and do business, such as a fire in our building. External SBDs prevent the operation of the securities markets or a number of firms, such as a terrorist attack, a city flood, or a wide-scale, regional disruption. Our response to an external SBD relies more heavily on other organizations and systems.

PROTECTING YOUR INFORMATION

We restrict access to your nonpublic personal information to those employees and agents who need access to the information to perform their job functions or provide products or services to you. We protect your nonpublic personal information from access by third parties by maintaining physical, electronic, and procedural safeguards. We strive to ensure the protection of clients personal information from receipt through destruction.

INFORMATION WE DISCLOSE TO THIRD PARTIES

We do not disclose any of your nonpublic personal information to non-affiliated third parties without your consent as required or permitted by law or unless those parties are providing services or support to us and have agreed to keep your nonpublic personal information confidential. Examples of these parties include the companies or individuals we use to (a) execute and clear our securities transactions, (b) prepare and mail your account statements, (c) help us verify information, including identity, (d) provide us with consulting, legal and accounting services, (e) help us develop, operate, and maintain our services and systems, and (f) provide services and products to you, such as mutual fund companies, investment management program sponsors, investment managers and advisers, and insurance companies. Even if you cease to transact business with us, we will continue to apply the same protections to your nonpublic personal information as we did when you were an active client.

CHANGES TO OUR PRIVACY POLICY

We maintain a public internet site at www.benjaminsecurities.com. While this policy is delivered annually in writing, the policy may change from time to time. We will notify you of any changes. You can always review our current policy online.
